Which obligations apply depends on the system's own risk profile, not on the word AI appearing in the tender. In the EU and EEA, the AI Act's risk-tier structure is currently the most developed version of this test in force anywhere.
Software with dual-use export-control exposure
Most markets that buy this kind of software operate their own dual-use export-control regime, and it can apply to a transfer or to technical assistance even within a single trading bloc. In the EU, Regulation (EU) 2021/821 is the current instrument.
Genuinely novel AI or software bought through a dedicated R&D-to-purchase procedure
Rather than an ordinary supply tender, when the buyer's need cannot be met off the shelf. In the EU, this runs through pre-commercial procurement or an innovation partnership under Directive 2014/24/EU.
How this market buys
The European Commission's Public Buyers Community, which publishes the Model Contractual Clauses for AI procurement, is the clearest EU-level reference point for how public buyers are operationalising AI Act obligations. Research-funding programmes such as Horizon Europe fund research directly as grants rather than as contracting authorities, though they and national equivalents elsewhere do use pre-commercial procurement as a funding mechanism for genuine R&D competitions. Where dual-use-adjacent technical content is involved, each country names its own export-control licensing authority, separate from the buyer.
